Prohibited and Restricted Items
Before you list your item, you need to find out if your item is allowed on 4Sale4Now and if the type of item is subject to certain restrictions to avoid potential issues with your listing. As a 4Sale4Now seller, you are ultimately responsible for making sure that selling an item is legal in the eyes of the law. Violations of these policies may result in a range of actions, including:
- Listing cancellation
- Limits on account privileges
- Account suspension
- Forfeit of 4Sale4Now fees on cancelled listings
When policy violations occur, 4Sale4Now emails the seller, as well as bidders, that a listing has been ended. You may contact 4Sale4Now to report violations by contacting 4Sale4Now Member Care
Understanding the rules about prohibited and restricted items
- Policies about listing items are often based on country and state laws. However, many restrictions may involve the sale of dangerous or sensitive items and are not necessarily prohibited by law. The limitations are the result of input by numerous stakeholders, including the Community. For example, see Offensive Material Policy.
- When selling across borders, be aware of international trading and import restrictions. Certain items may be legal in your country, but may be illegal elsewhere.
- Just because a particular type of item is listed below, it does not mean that it is completely prohibited. For example, in the Medical Devices Policy, many items are prohibited (for example, contact lenses), but many others are allowed - under certain circumstances (for example some medical instruments). When in doubt, you should read the policy page carefully. The policy pages contain these details under Additional Information and Examples. Note: Examples are designed to help explain the policy and should not be viewed as an exhaustive list.
- It is also important to review the Rules for Listings and the Rules about Intellectual Property to check if your type of item has additional restrictions that would affect your listing.

Restricted Items List:

Art - Only the lawful sale of art is permitted in order to protect the interests of the artists and prevent fraudulent transactions. Any Seller of any Art must not knowingly list for sale any unauthorized copy or reproduction of any work of art or any item that infringes the intellectual property rights of any third party. In the even the item is an exact replica work of art the item title and description shall clearly state that the work of art is a reproduction. The item description must not list the art as "genuine" unless the Seller has reasonable proof of its authenticity and must not contain any false or misleading information as to value, condition or investment potential. Any information regarding any alterations, conservation or repairs performed on the art must be clearly indicated. The artist's name shall only be included in the title of the listing when the work of art was done by the artist him/herself or an exact replica of the artist's work.

Event Tickets – 4Sale4Now only permits the lawful sale of event tickets (including, but not limited to, tickets to events such as sport games, concerts, and plays). Several states have specific laws limiting event ticket resale prices. It is your responsibility to know and comply with the laws of any applicable state regarding resale prices. As a Seller, you are responsible for ensuring that the sale of an event ticket does not violate any applicable law.
In addition, in listing an event ticket for resale, the starting resale price may not be greater than the face value of the ticket. Face value includes the price of the ticket and any service charge and tax charged by the original ticket provider that is printed on the ticket.
4Sale4Now also encourages the sale of ticket packages. Ticket packages are generally exempt from state ticket resale regulations, but it is the Seller’s responsibility to ensure that the sale of the item does not violate any applicable law. To qualify as a “ticket package,” the listing must include either (1) at least one item of experience of substantial value related to the ticketed event that, as the Seller, you have coordinated with the event promoter, team, manager, artist, or venue (items of experience having substantial value include, but are not limited to, a backstage pass, a meeting with a performer, or an "experience" such as being a bellboy at a basketball game) or (2) a complete travel package, specifically including airplane tickets to the event and commercial lodging for one night. These additional items may not be separated from the event tickets themselves and still remain categorized as a “ticket package.”

Food - The sale of certain items of food are prohibited and prior to making a listing for any food item, you should read the "Prohibited Items" section (section 3) of these Terms of Use.
The sale of food is regulated by federal and state law. As a Seller, it is your responsibility to familiarize yourself and comply with these laws prior to listing food or food-related items.
Any listing for perishable items should also comply with the following: (1) clearly identify the steps that will be taken to ensure the items are delivered to the Buyer safely; (2) packaged and/or sealed to ensure that the evidence of possible tampering are readily identifiable, and (3) must be delivered to the Buyer prior to any clearly marked expiration or "use by" date.

Gift Certificates / Gift Cards - In order to discourage fraudulent transactions, 4Sale4Now restricts the sale of gift certificates and gift cards as follows:
(1) The value of the gift certificate or gift card may not exceed $500.00 USD and the initial listing may not exceed the face value of the gift card.
(2) Gift certificates and gift cards must be in the Seller’s hand at the time the listing is posted.
(3) Only one gift certificate or gift card may be listed by a Seller every 7 days.
(4) Multiple gift certificates or gift cards cannot be combined under a single listing.
At its sole discretion, 4Sale4Now may exempt first party gift certificate or gift card suppliers, or authorized 3rd party contractors, from all or some of the above listed restrictions.

Travel - The sale of certain travel items are prohibited and prior to making a listing for any travel item, you should read the "Prohibited Items" section (section 3) of these Terms of Use. The business of arranging travel packages, providing travel certificates, or operating travel clubs is heavily regulated in many states. As a Seller of such items, it is your responsibility to familiarize yourself and comply with any such laws.
In order to discourage fraudulent transactions, 4Sale4Now restricts the sale of travel tickets, vouchers or certificates by individuals who are not in the business of selling travel services as follows: (1) only one travel item may be listed by a Seller per month and (2) the Seller shall not play any role in arranging any travel other than delivering the item to the Buyer.
In addition, many airline tickets, vouchers, and frequent flier miles are nontransferable. As a Seller of a travel item, it is your responsibility to review any item prior to listing to verify that it can be transferred legally to another party and will be accepted by the issuing provider of the travel service.
Businesses that actually provide travel services, such as airlines, hotels and cruise ships, may directly list items for sale such as their own gift certificates, tickets, or vacation packages. Direct providers of travel services should clearly identify themselves in the listing as the actual provider of the travel services offered. Direct providers of travel services may be exempted from state seller-of-travel laws and as a result may not be required under state laws to have a license to sell such travel services, however it is the Seller’s responsibility to comply with any applicable seller-of-travel laws.
Businesses and individuals who sell and/or arrange travel or accommodations, but do not directly provide the travel or accommodation themselves, may list travel related items including accommodations, only if (1) they are licensed sellers of travel lawfully able to do business in all 50 states, (2) they themselves will be booking the travel for the Buyer, and (3) their Seller of Travel License Number as required by California law or other similar license information required by any other state is included in the listing. Additionally, any such listing must state in the listing (i) that the Seller is the actual travel agent or travel provider, and not a third party affiliate, that will be directly booking the travel and (ii) that, other than the government taxes and related government fees stated within the listing description itself, there will be absolutely no additional fees, charges or required purchases associated with booking the travel listed.

Used Clothing (except underwear) – Used clothing must be thoroughly cleaned according to the manufacturer's instructions prior to sale.
